What's required in a deposit itemization?
Most states require a written statement that lists each deduction separately with a description and dollar amount, the original deposit (plus any interest owed), the resulting refund or balance due, and the date. Many states also require receipts or estimates for repair work, and the statement must be mailed to the tenant's forwarding address within the statutory window. What happens if I miss the deadline?
Missing your state's deadline usually forfeits your right to withhold anything — and often triggers statutory penalties on top of returning the full deposit. California allows up to 2× the deposit in bad-faith cases, Texas allows 3× the wrongfully withheld amount plus attorney fees, and New York allows up to 2× for willful violations.
